Re: Careless driving incident
Let me start this off by saying I'm a new driver (got my G2 around June). Anyway, I was taking a left turn at a yellow, got t-boned and as a result automatically at fault. (I don't personally believe this but don't feel like disputing that now). Damage was pretty big, both cars are going to get written off but, no major injuries. There was one ...

Re: Are HTA offences considered civil or criminal?
They are not civil or criminal, they are provincial laws.

Re: Jurisdiction and Court Location change
Your offence occurred in Toronto, and your trial is happening in Toronto, so your trial is happening in a court in the jurisdiction of the offence. If the officer is from any of the following divisions in Toronto your courthouse IS 1530 Markham Rd.; 32, 33, 41, 42, 43, 53, 54, PDS, and ETF. There might be one more but I think that covers it. If the ...

Re: Is there a way to find out who complained about your par
And regarding getting your neighbours name, I think it would be a bad idea.... confronting them (retaliation on them) is just going to get you in more trouble than its worth. And even if someone did call, the officer is still going to chalk your tires because then he doesn't need a witness for the trial, he can be the only witness required.

Re: 136 (1) (b) collision, ticket errors.
The ticket itself will be quashed during the filing process because it will be seem to be beyond the required 7 days for the officer to file based solely on the offence date. This however does not mean you are free and clear. The officer has 6 months to realize his/her error and reserve you. As for what you do for a company that fires you, that is ...

Re: Dangerous driving charge
Hmmm..... sounds to me like there is more to this story. Is it possible that when you were running, you were running from the police? It seems odd that you would be charge for dangerous driving based on what you wrote.

Re: Truck driver - careless driving
I think I'd wait for disclosure and then decide on the plea. At least see what all the evidence is. Also I find at the time the person who complains is all wound up and it is the biggest problem in their life. Come the court date though and the kids have to go to school, someone else has to be taken to the doctors, work wants to know when he will ...

Re: Speeding - 115km/hr in a posted 60km/hr zone
I would say you count your lucky stars because I am going to guess you got charged with the speeding only and not the Stunt because you said your car wasn't towed. If you are charged with stunt the office SHALL impound your vehicle.

Re: Interpreter on Trial, how to find the status of request?
The Notice of Intention to Appear will have your request for the interpreter and the language reqursted signed by you. That will be in court on your trial date showing you requested an interpreter. Not sure where your ticket is filed but if it is in Toronto and the interpreter isn't in court you have a good chance to have the ticket thrown out.

Re: 66 in a permanently-posted 40 kph zone/CSZ
Thanks Stanton,
Ok so my car might achieve 66 kph in 150m from a near-standing start, if I absolutely burry the throttle. If the judge/JP buys my claim that I was coming from the store's parking lot en-route to receiving my ticket, and even though he/she knows its unlikely I was hard-accelerating all the way to the beginning of the 40 kph zone ...

Re: What rules govern how cops can create traps in Ontario?
There is nothing that requires a police officer to put his car where you can see it, if there was they might as well just tell the officer that he must leave his emergency light on too while he is working. One thing people need to understand is it may be called a speed trap, that doesn't mean it is.... You had fair warning of the speed, there are ...

Re: What length driving record will be relevant to prosecuto
Certainly would make it easier for me but the Prosecutors I have wouldn't even consider it. If they see it isn't certified they will just hand it back and put in submissions as though it is the first offence.

Re: What length driving record will be relevant to prosecuto
I have only ever used a 3 year record. It isn't one that I print out but one applied for through the Ministry of Transportation which is signed and Certified under their Seal. I have never heard of a court accepting a printed copy made by a Police Officer as an exhibit for sentencing. Although you are correct, the entire record remains forever I ...

Re: What length driving record will be relevant to prosecuto
They will only be relying on a 3 year driving record, not back to the beginning of your record, unless you have criminal driving convictions related to driving, they will show up on the driving abstract presented at sentencing.
