You should also consider organizing either:
1) A coup to elect yourself and your friends to the board so you can fix the bylaws.
2) Organize a bylaw change to specificially allow 2 your situation.

If you go to court the justice cannot do anything about the number of points associated with the charge. They can find you "not guility" or reduce the fine amount, but they have nothing to do with points.
Your only way to reduce the points is to go to court and beat the ticket or try to get a plea bargin for a lessor charge with fewer points ...

Re: Improper disclosure – What would you do?
You have the time, so make the adjustment to your disclosure request and send it off.
I think the odds are in your favour that you will receive a very similiar package to your first request. This should put you in a stronger position to get a Stay for Non-Disclosure.

Re: Passing Stopped Cars at a Crossover
Wow, thats a big change in information.
1) First thing to do is contact your insurance company / law firm they have representing you. They may be willing to pay for or subsidize a lawyer for this charge as it could effect the bigger case.
2) The law firm doesn't need to pressure the crown to lay charges. They probably just went to a justice swore ...

Although it's not directly stated I'm assuming that you where pulled over by a police officer at the time of the incident and issued a warning?
My guess is then that you received the summons because too much time has passed for the Police Officer to issue a ticket, but for some reason the crown has decided to lay a charge via the summons.

I believe the former AG Michael Bryant decided that this was legal when the offending vehicle was a bike.
It shouldn't be hard to argue that a Kia and bike are similiar enough to warrent the same treatment.

Police don't a reason to stop you. Under the HTA they can stop you to check if your license and other paper work is valid.

Re: Help - Section 74(1) No Clear View to the Front
So I spent most of today, sitting around court to have this dealt with. It seems the charge was unusual enough that the crown wanted to deal with it last :( And then we ran out of time. So I now have another court date to set up another trial. It seems the earliest dates that are available are in the new year, which is putting me close to 11b ...

Re: I need help- careles driving, HTA130
Stopping on the side of the 401 is clearly not Careless Driving. However, most people recognize that it is a dangerous thing to do and avoid it.
Cars that are stopping on the side of the 401 are usually a result of
1) Break down
2) Young children that cannot hold it any longer
3) Cop with Customer.

Re: I need help- careles driving, HTA130
I was driving on 401. At a moment I decided to make a five minutes stop on the right shoulder of the highway.
I think this is your first problem, is that it isn't really believable that you where going to randomly pull to the side of the 401 for a 5 minutes break, the side of the 401 just isn't safe.
If this is what you wrote in your statement ...

you already received the "front" of the ticket. Do not know why you would require to see the same copy again? If the back of the copy is blank, why would that be needed? Possibly is that the "printed" notes you already have?

Re: Help - Section 74(1) No Clear View to the Front
I used the forum from DK as basis to request disclosure, and I have just received my disclosure package.
It contained:
1) a copy of my disclosure request
2) a print out of the "ticket offense hardcopy" which is the typed information which was on the orginal ticket.
3) Typed officers notes.
What's missing is
1) Any hand written notes - Is it ...

From what you write, it seems the sign isn't in French and thus is invalid.
I'd suggest looking up the French Language Services Act defense.

Re: red light camera offence ticket
Peel Region has been using the wrong ticket since the beginning of the year. Basically every red light camera ticket they issue is invalid. I am currently in court trying to get a ruling but it's been deferred to August. But that shouldn't stop you from making the same argument.

Police officer all seem to wear Sunglasses.
Are these offical parts of there uniform? Or are there shades more of a "cop culture" thing?
If it's a culture thing are there any regulations around which ones they can use, since they all seem to use a similiar style?

This charge is hard to be enforced, as you are not supposed to idle for more than one minute (also a law). Therefore, to use the car's heater to melt the frost and wait idling 3-4 minutes, which is illegal

Help - Section 74(1) No Clear View to the Front
I'm not certain if this is the best place to post this but I couldn't find a better spot.
