82 in a 60, but ticket says incorrect district

Unread post by Speeder »

Traveling near the board of York/Toronto and an officer in a "fishing spot" stopped me for going 82 in a 60. It was a Toronto officer, but technically we were in York Region. The ticket says District: Toronto but the address on the ticket, where the incident occurred is not listed as a Toronto address. Will this get thrown out? It was not a entry error, it was intentionally written to Toronto. I don't think it's fair that I would pay Toronto the fine, or go to Toronto court for something that happened in York Region.

You're pretty much out of luck. The Provincial Offences Act provides that a proceeding may be heard in a county or district that adjoins that in which the offence occurred. See section 29 of the POA if you want to read it in its entirety.
