I sent a disclosure request to the police officer and he gave me most of the requested items, when it game to disclosure of the lidar operating manual he says he will not do to copyrighted material. From seeing examples of other lidar manual it does say copyright on the bottom of these manuals, but the manual is critical for me to make a full answer and defence to the charge. Is there any case law that states the manual needs to be disclosed or what angle should i take to argue non-disclosure of the manual in court ? since the officer is right in that it is copyrighted but i do need it to make my case.

And it's binding on lower courts. The only possibility of turning this one over would be taking a similar case to the Ontario Court of Appeal.
