Careless driving

This is a two part question. First my girlfriend was driving my vehicle when she dropped her drink from the cup holder veered into the oncoming lane and struck another vehicle. She was charged with reckless driving, this is her only conviction to date and was completely by accident and a lack of driving experience. Is there anything we can do for her? Second part was what we said in the insurance report where we stated that I had changed the radio before the crash (I was passenger). Her mother seems to think That I had something to do with detracting her and that I am to blame for the crash, So my question is can I be charged with distracting her even though I had no control of the drivers wheel.

You can not be charged for careless driving in a situation like this if you were the passenger.

You stated it's her only conviction implying she's already been found guilty. If that's the case, there is little you can do. If not, she should get legal representation to fight the charge or seek a plea deal to something less serious.
