Re: Disobey Sign HTA 182(2) Kerns Road, Hwy 5 (Dundas St)

nerd, Thanks for your comment. You may or not see from the photo, the road closure sign is for "through traffic". if I didn't plan to drive through the actual construction area or one-way road conversion area, then I shouldn't be not guilty? The area I got the ticket is popular hiking area so many ...

Re: 134 in a 100 - Possible fatal error

It is nearly impossible to win a speeding ticket that is 30+ over the limit because you're clearly, blatantly speeding. Agree with Stanton. It's on the basis of the evidence, not the raw speed. Example: The kid who was caught doing 238 in an 80 zone a couple of years ago was found not guilty, becau...

Re: 134 in a 100 - Possible fatal error

It is nearly impossible to win a speeding ticket that is 30+ over the limit because you're clearly, blatantly speeding. I'm not sure what you mean by this. Your chance of successfully fighting any speeding ticket would be based on the strength of the evidence, not your speed. Speeding is an absolut...

Re: 136 on QEW Westbound near Gray's Rd

You cannot be driving 136km/h and have any reasonable defense. Incorrect. It is called "defence of necessity." If you or someone in the vehicle has a life-threatening emergency, that is a valid reason for speeding. It is a rare occurrence, but if the defendant is truthful, it is valid nonetheless. ...

You can't negotiate the points.
Sorry, that wasn't said well. I mean negotiate a reduced or ammended charge that does not carry demerit points.

Re: seven summons at once. Big help needed (((

Hello. So basically I purchased a vehicle just yesterday and decided to take it for a small highway drive and obviously got stopped by the cop. Sad thing is - I only have G1, no insurance, no permits, no nothing.... I know this is the dumbest thing you can do... but I did it and now gotta live it t...

Re: Was this person wrong?

In the drivers handbook, the rules of the road state that you do not change lanes to pass a bus which is temporarily stopped to load or unload passengers. It's not a law, but driving education teaches this as well and if you pass a bus in this manner during your driving test, you will get docked for...

The street is a long one and only at either end of the street (not the middle where I parked is there any notice that I may not park their during certain hours that are for permit parking on...

Re: Disobey Sign HTA 182(2) Kerns Road, Hwy 5 (Dundas St)

You failed to disobey sign because of the 2 "DO NOT ENTER" signs facing you (white signs, red circle with white horizontal line). Oncoming traffic is irrelevant. They are also posted on the left and right side of the road, indicating zero access is permitted from either side of the road you're appro...

Re: Should this speeding ticket(s) be thrown out for miscond

You were driving 110 in an 80. The officer likely reduced it to 100 in an 80 to save you the 4th demerit point and having a major infraction on your record. You complained, so he wrote you a ticket for the full infraction, which he can do if you dispute the reduced infraction. If you dispute a reduc...

To be frank with you, you're guilty on the grounds that a "number plate to be kept clean". Re: Prosecutor threw out my offence but still got a court da

If you received a summons for court and they cannot find it in the system, give them the offence numbers on the tickets to find their status. If you should be in court but do not show, it will only make the judge angry and end up with a charge for failure to appear. They probably dismissed the speed...

Update: I went in for my trial and the JP was absent. I was offered a reduction to 119, which I refused, and then I was called into the courtroom and given a new date in August. Are they allowed to do this? I'm guessing that the "adjournments" are sent to a JP afterwards to actually be adjourned, b...

Re: 136 on QEW Westbound near Gray's Rd

The cop does not have to show you the radar. You cannot be driving 136km/h and have any reasonable defense. You're not 10 over, 15, 20, or even 30 over. You're 36kph over the speed limit, which is not an oversight and has no defense. You will have received 4-demerit points for driving 36 over the li...

Re: More than 15 days since I was issued ticket

I thought that you really had 45 days even though the ticket says 15...A cop told me this once. I hope it's true! It states 15-days directly on the back of the ticket with 3 choices: 1) Plead guilty and pay fine 2) Plead guilty with explanation (usually goes to court to reduce charge/cost) or 3) Pl...
