I've got a speeding ticket 70 in 50 zone on the rural road north of Guelph. Reduced from 93 km/h. There is no "R" code on the ticket if it does matter.
I am thinking about requesting a trial, but it is different from my previous experience (8 years ago).
Regarding trial request
1. Can I send a trial request by mail, just filling out the option 3 ...

Re: How do I file a Form 4f?
I didn't use form 4F. I followed the process described in this topic: http://www.ontariohighwaytrafficact.com/topic2808.html

You can call to 860 William Street, Cobourg and ask them where to send documents to court and prosecutor. Or, you can fax them everywhere, to Cobourg, Brighton and Port Hope, just in case.
I am not sure if this acceptable to serve court and prosecutor by fax. Probably, somebody more experienced than me can answer this question.

Re: Incomplete disclosure – unsuccessful motion of stay.
I am trying to estimate which options I have now.
As far as I understand, my opportunity just to pay the fine which is on the ticket ($95) without visiting court has gone since I applied for a trial. So, thats not an option. Is that correct?
If I wont show up on the next trial, how much will I have to pay? The same amount as for 39 km over (~$350 ...

Re: Incomplete disclosure – unsuccessful motion of stay.
What is smth? = Smith?
smth = something
Courts plan there time based on pleas (5min) and trials (30min +). If they know then have 10 pleas that will be 1 hour to get done moving at a fast pace. So the court blocks off an hour of time. Then they might have 10 trials, so block off another 5 hours of the day, now that is 6 hrs, add lunch 1 hour ...

Re: Incomplete disclosure – unsuccessful motion of stay.
Thank you, Simon, for detailed answer. This is really helpful.
I still don't understand though why prosecutor set one week limit to his bargain? My next court date is in June. Is that sort of pressure or smth. like that? I am trying to guess his intentions which could be useful if I decide to continue this game.

Re: Incomplete disclosure – unsuccessful motion of stay.
So, I have to drive to Cobourg one more time anyways... Too bad... In that case, may be I should continue to fight this ticket.
What's the point to make a deal in advance then? What are the benefits for me and for Crown? I thought, if we are making a deal in advance, Crown doesn't need to care about bringing cop to the court, and I also do not ...

Re: Incomplete disclosure – unsuccessful motion of stay.
If I decide to accept the deal, how to manage it properly? Prosecutor said I should contact him by fax or phone in a week, pay fine, and that's it. I asked, if I get any confirmation of the deal from him. He said, he can send mail to me or leave voice message on phone.
So, let's say, I send him a fax, stating I agree to be convicted for 115km/h in ...

Incomplete disclosure – unsuccessful motion of stay.
I got my ticket for 139km/h on hwy 401 in Cobourg area in September 2010. Ticket was reduced by cop to 120km/h. I received notice of trial in December 2010 with court date in March 2011. I sent disclosure request in January 2011 and didnt get any response. I sent follow-up request (registered mail in both cases) in February, no response again.

Precedent-setting cases for Charter s.7 and s.11(a)
I filed Appication for Stay of proceedings based on Charter s.7 and s.11(a), based on he fact I didn't get disclosure form the Crown (explanation and clarification of the charge). Does anybody know any precedent-setting cases for that? I didn't include them in the application of stay, but I think I should have them on trial. Any ideas? Thanks!

Re: Didn't get disclosure -> Trial adjournment?
At my trial I approached the prosecutor, and she asked if I plead guilty, or not guilty. I said not guilty (HOV lane). She said I can plead not guilty only if I have evidence that I wasn't in that lane. If I was there for some reason, I should plead guilty with explanation. By this time, I saw my cop in the room (but wasn't 100% sure that this is ...

Didn't get disclosure -> Trial adjournment?

I sent disclosure request 7 weeks before the trial and didnt get an answer. After 3 weeks, I sent another disclosure request and didnt get any answer again. Now my trial day is coming in a couple of days. The trial is at Scarborough (Toronto East).
