What Can I get this Disobey Sign reduced to? ***See Pic
I made a right turn in a Four way stop [/color] during the prohibited time (4 to 6pm.. Buses, bikes, taxi excepted). The officer hit me up with Disobey Sign. What Can I have this charge reduced too? Can't I make a By-Law (Prohibited Right Turn) Argument?? I know Improper Left/Right turns and HTA 144(9)Proceed contrary to sign at intersections have the same amount of demerits so there is no point of reducing it to those charges. Does anyone have experience or any suggestions on what to have the charge amended to? The regular amended charge for disobey signs are usually HTA 144 (10) Disobey Lane...

The prosecution does have grounds to bring you back to court for a retrial. The charges have been stayed, and there is no statue of limitations for them to challenge you or revise the stayed decision. When you file a charter motion to get the charges stayed.. It basically means you want the charge to be paused, and proceed no farther. But the prosecutor can bring these charges back if they wish.. But more often then not, the crown only bring back criminal matters that been stayed, and not traffic matters. Does anyone know what determines what turning charge you will recieve out of prohibited turns, bylaw turns and disobey signs.

Right turn Only Lane (Kennedy and Ellesmere)
Right turn Only Lane, but went straight.. is 182(2) correct? Here is another disobey question. I was on heading southbound on Kennedy towards Ellesmere and there are 3 lanes. Left turn, centre, and right turn lane. There was a sign posted with a right turn arrow, but that was posted almost 50 yards before the turn.. There is no visible sign where the turn is. I went straight on that right turn lane and I merged onto the centre lane about 80 yards after I crossed the intersection. The reason I didnt noticed that it was a right turn lane only cause beyond the intersection there was a lane for me...

What determines disobey sign and bylaw improer turn?
Hello, what determines between HTA and Municipal bylaw? There are some disobey sign $110 (eg. making a right turn between 4-6pm) and a bylaw improper turn (3-6pm) for 18.75. They both seem to be very similar.. My dad got a bylaw ticket for 18.75 for making a left turn into a small street on the invalid hours indicated. My brother got a disobey sign for making a similar turn on a different street at a different time frame. The only difference is that the disobey sign has a stop sign prior to turning. And the bylaw is a straight left turn without stops. can someone let me know what classifies as...
