Misspelled city, fatal error?
Friend was in an accident today, charged with Careless. Looking at the ticket I found that Mississauga was spelled Mississga. Because it involves establishing jurisdiction, does anyone know if this could be used to force a fatal error?

Anyone ever hear or have any experience getting an HTA speeding charge plead down to the relevant city bylaw? Not overly concerned with the fine or points, just don't want a conviction to affect insurance so I've been looking and found that Mississauga has a speeding offence in its traffic bylaw... Hi there, quick question......
Got a ticket for 24 over, but I've noticed a few things with the ticket and am wondering if they're fatal errors...
1) It was in a community safety zone, but the charge just says speeding 74km/h in a posted 50km/h zone.... nothing about the community safety zone, and it's the regular fine, not the csz one

1. mis-spelled the abbreviation of by street - bld instead of blvd. My view on this is how can you accurately see a small black phone in a vehicle with a darker interior 20~30' away when you can't see a V printed on a license 1 foot away. Secondly, how reliable and true are his notes with such a blatant error.

I would go to court but not check in with the prosecutor or answer them when they page. At least that way you can see right away if it's quashed or if you'll have to appeal it.

The T stickers are temporary ones... they got rid of temporary plates and replaced them with temporary valtags on permanent plates. The striped ones are on Ont gov't vehicles because they don't require valtags every year.

I have a neighbour who's life was significantly impacted by a drunk who decided the he was fine to drive after a few drinks, and when he was convicted in court was pissed and yelled that they should be convicting 'real' criminals. This neighbour's now confined to a wheel chair for the rest of his life. I wonder how many times an impaired driver ...

I think they're appealing because previously most courts accepted the sworn testimony of the officer confirming that they were qualified proof enough that they were qualified.

the officer could have "seen" that the seat belt buckle was next to your son's head..... or that he was trying to put it on when he noticed the cop....

What your father-in-law got is probably a summons, so that court date, which I'm assuming is in Newmarket, is only to set a trial date. Probably why you haven't received disclosure yet.

Although there are a couple of judgements saying that the 50 over part of the legislation is unconstitutional, there's now another judgement from a few weeks ago saying that it's ok. Until a decision comes from a high enough court, you'll continue to see prosecutions.

"highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof; ("voie publique")

Well I think it is unreasonable... the police harass and threaten people all the time and Joe Public wants to go home to their families in one piece too.
