What Are Possible Pleas For 141(5)?

Unread post by DrivingDave »

I'm thinking of taking a plea bargain but I can't really think of anything at the moment that I can lower the offense to. I've made a bad left and the car t-boned me. However the officer recommended I argue it in court so there's probably something that I can do. He mentioned that I should say that I only have a G2 or something and just started driving.

Thanks for your help.

It's not your choice.

The prosecutor may, if they choose, offer you some kind of plea deal. But they are not required to do this.

Just to expand on what jsherk said above, the prosecutor will choose what he/she will offer as a plea bargain, furthermore and I am not 100% sure about this, but I think they are also constrained by what they can offer as a deal depending on what the original charge was.

What I mean is, they can not replace a "failed to stop at stop sign" with "speeding 10Km over posted"

Two completely different charges and sections of HTA.
