135 On 100- 401 Near Whitby On

Hi,

The cop has pulled me over and then he mwntioned that i have passed him (he claims he was doing 115 to 120) and for half a km there I was doing 135 and then I have been follwoing too close. Not that i exepect him to have sympacthy, but i have recieveed a cal;l from my kid's daycare to come and pick him up as he had fever. he started explaining that off course this is not a valid reason. I offered the daycare phone number to show the crediability of my story. He wrote me a ticket for the full 135..


My record has a couple of tickets , one cell phone that other is a speeding from 4 years ago.

should I go into a guilty plea or fight it in court.

You have nothing to lose (except free time) by speaking with the Crown. For speeds of 30+, the fines go through the roof. If you were able to plead to 29 over, you'd only have 3 demerit points instead of 4 and the fine would drop to $139 from $265.


As for fighting it outright, you'd have to check disclosure and see what the evidence against you is. If it's a strong case, I'd suggest taking a plea. FYI, even if your child is sick the Courts can't accept that as a reason for you to be speeding, just in case you were planning on presenting that as a defence.
