Child Car Seat- Which Offence

What is the difference between these two offences.


-Driver failing to ensure that a passenger under 16 years is wearing a seat belt


-Driver failing to ensure infant/child passenger is properly secured in an appropriate child restraint system or booster seat


I was given a ticket for "driver failing to ensure that a passenger under 16 not wearing seat belt".


the cop saw my two years old toddler not properly secure in the child car seat. (why he was not secure its another story).


Can the two ticket be issed alternatively. I think he should charge me for later offece. Please any advice. I want to challenge the ticket that the charge is not correct.

I think that this is what the cop wanted. You take the ticket to court, one gets dropped, but not the other.
