Guys, I received disclosure with just 2 business days (and 4 including weekend) before the trial. Is this enough time to properly prepare or can an adjournment be made? Furthermore, the disclosure doesn't include all that I request. I requested disclosure for the following:
o a full copy of the police officers notes; - RECEIVED

Guys, i am a little late with my request for disclosure - I am requesting it as of June 9th 2011 via fax. Trial date is now July 11, 2011, which leaves me with 4-5 weeks till trial. Will the crown or JP tell me that I am out of luck if/when they do not provide the disclosure in time, and I request an adjournment based on that? This trial has ...

Guys, I need help here in requesting disclosure. Some sort of Radar (not sure if it was Radar, LIDAR, Laser, etc) was being used, in really poor weather conditions, when it was turning dark (think winter time, around 4pm, dark cloudy skies, and falling snow). Anyhow, what should I request on the disclosure?

Hey All,
I got my speeding ticket heading to montreal (eastbound) on the 401 in brockville by 1000 islands, and was charged with 133km/h in a 100km/h zone. I know I wasn't going that fast, as the weather was pretty bad (i.e. snow, slushy roads, etc). Anyhow, I need to file an option 3 (intent to fight it).

My problem is that I live downtown ...

I received a speeding ticket of 120km/h in a posted 100km/h zone (hwy 401), however the officer did not use radar on my vehicle. Rather he said he followed me and that I was speeding according to the speed of his car. He also said that I was driving in excess of 140km/h but he was writing me a reduced ticket of 120km/h. Absolutely reasonable IMO. Maybe try asking to have the charges dropped because of it. Likely they will just adjourn at that point. But have the proof that you sent the disclosure request. You sent registered mail right? so you have a signature of someone who recieved it, right?

Hi All:
I requested disclosure 6 weeks ago, and I have my traffic court date set for tomorrow.

Is it reasonable that I request that the trial be adjourned until I have been provided with both the disclosure and enough time to review and prepare my defence?

Further, I have already adjourned the trial date once prior for a different reason.

All, I requested full disclosure about 6 weeks ago, and it still has not arrived. My court date is tomorrow. Can I reasonably request that the date be adjourned until I receive disclosure and prepare my defense? I have already had the date adjourned once already for a different reason...

Hi All:
I got a ticket for disobeying a stop sign, however I did stop! The problem was that the officer said I stopped past the white line, and on the ticket wrote "stopped wrong place!". Anywyas is there anything I can do to fight this?

It's a bit late to try to construct a solid defence here... did you happen to get disclosure of the evidence against you? If not, no big deal, but what I'd suggest is try to look for a plea-bargain to a municipal by-law infraction, if the officer shows up. The benefit there would mostly be with your insurance, and a slightly lower fine. If the ...
