I will definitely bring this up in court (if I have to proceed with trial that is).
However, I did find some case law with respect to external testing that does not support this argument.

RI, thanks for the reply. I already contact the toronto public library. They have a copy for reference only (i.e. i cant sign it out).

With what you just wrote, I wouldn't want to answer the questions........ However, HwyBear has mentioned in the past that there is a fourth test. It is completed in the office by a guy on a computer.
