Finally got something in the mail... Notice of Fine and Due Date.
I didn't even get a letter for early resolution meeting I requested or a trial! How can I be convicted of an offense without a trial?
What do I do? Best option is to call in and get the case reopened?

Re: Going 83km/h in 50km/h zone
I mailed in the ticket at the beginning of June asking for an early resolution. I haven't gotten anything in the mail yet, been 5 months almost.
What is happening? What should I do? How do I check the ticket status?

Re: Going 83km/h in 50km/h zone
See attached image. Still nothing? I turned into the road and drove 80km because thats what my intuition told me (been on it before, others were going same speed, etc). There were no signs at all between where I turned from and near the cop. I see the 50km sign and I slow down. Cop catches me anyways. Drive a bit more and the road does turn into 80km.
No case at all?

Re: Going 83km/h in 50km/h zone
One detail.. this road is 70 at some parts. The part I was driving at was 50 but there was no sign until near the cop. If you keep driving a couple mins past the cop it turns back to 70 again. Does this affect anything strategy/defence wise?

Re: Going 83km/h in 50km/h zone
I have a G. I don't have any other tickets except for parking tickets and a careless driving ticket that I won.
So I am not sure how it will affect my insurance.

Going 83km/h in 50km/h zone
A couple nights ago I got a speeding ticket, here is what happened: I turned onto Mississauga Road (Peel Regional Road 1) in Brampton going southbound towards Georgetown. It was a huge road and mostly empty, I am new to the area but by the looks of the road (looks like a regional highway) I assumed speed limit was 60-70km/h, I did not see any signs. I drove for a few minutes and saw a sign that said 50km/h, a railroad, and a cop suv all within a few metres. I slowed down immediately. The cop pulled me over and said I was going 83km/h. I kinda avoided his questions but told him I started slowin...

Re: After accident, the police gave me a Careless Driving ti
Thanks for all the help. I had my trial today and I figured I'd give a run down of what happened. Walked into courtroom. Saw the cop walk in. Didn't see witness anywhere. Went to talk to the prosecutor. He said he will drop the charges if his witness doesn't show. If the witness does show, then he will offer me "failing to stop [...]" can't exactly remember. 0 demerit points and $85. I agreed and thanked him. Watched all the other trials take place, while keeping an eye at the door to see if the witness would show. Finally I went up, the prosecutor called for the witness. No show. Ju...

Re: After accident, the police gave me a Careless Driving ti
Thanks for your responses. A couple things: - After the accident, the other driver said to me that he stopped fast because of the sun and sorta apologized. - I told the cop that I slowed down as soon as the sun impaired my vision and I slammed on brakes as soon as I saw the car but it was too late I guess the above doesn't matter though as its not in the officer's notes. I have no problem taking a plea bargain and I will do so if both the cop and witness are there. But what if the cop shows up last minute after I miss my chance to take the plea deal? If the witness doesn't show up, how does i...

Re: After accident, the police gave me a Careless Driving ti
I'm looking through the disclosure / evidence and there isn't much for me to work with.
Basically it just said damage. Minor damage on other car's bumper. Bent hood and crack front bumper on my care.
For witness statement, it just said that he was driving and was struck by me from behind.
For my statement it says that I was driving, sun was in my eye, and I struck the other vehicle.
Doesn't seem like there's any case for "careless driving" based on this evidence, but how do I fight it? How do I win?

I know the process but will it get me anywhere? What if I am asking for too much?

Re: After accident, the police gave me a Careless Driving ti
A few weeks ago I mailed Disclosure Request: "General Request With regard to the above matter and in light of the guidelines set out in R. v. Stinchcombe, 1991 CANLII 45 (S.C.C.), and subsequent cases, I am requesting that you provide me with all relevant information and documentation so that I may prepare my defence against the above charge and make full answer. Specific Request Without limiting the generality of the above request, I ask that you also include: o a full copy of the police officers notes; o a copy of both sides of the officers copy of the ticket (Notice of Offence); o a TY...

Re: After accident, the police gave me a Careless Driving ti
Great comment. Thanks for posting.
I think I will send a disclosure request via registered mail with my phone number.
Then I will send another one every month until I get disclosure.
I will file for stay if I do not receive it.
At the court house if I see the cop, I'll take plea bargain. If I don't then I will proceed and hopefully have it thrown out.
If the other driver doesn't come, will it get thrown out as well. I'm 95% sure that he won't. He's a busy guy who travels a lot and didn't think I deserved the ticket.

Re: After accident, the police gave me a Careless Driving ti
After researching I've to the following conclusions.
Fax disclosure request from a canada post location as opposed to sending registered mail. it's cheaper and you have a paper trail. But how do I make sure they don't send a fax back to the same number? Can they see that number?
Include the phone number on the disclosure request. Best thing that could happen if you don't is an adjournment. I don't want an adjournment. Also, if I include the phone number, they have no excuse to why they didn't contact me.
Anyone have any objections to my above points?
