The remedy for lack of disclosure is a motion under s. 7 of the Charter that your right to make full answer and defence has been violated due to the lack of disclosure. Fine for driving without a licence is $325. No points since it's a non-moving violation. That being said, any offence can potentially affect your insurance, even non-moving violations, especially when they're related to licencing.

You don't need to request a trial just to get in front of a judge and ask for a reduced fine. That's what option 2 is for - to plead guilty with an explanation.

Just to clarify what Stanton said, it is ONLY the crown who has the authority/power to decide which charges will be pursued or dropped. The officer can make recommendations to the prosecutor, but they can't promise you anything (at the roadside or in court) because it's simply not their call.

The fact that the suspension was due to an apparent minor oversight which you have since corrected will go strongly in your favour if you try to get the drive suspend plead down to drive no licence. If you are suspended for unpaid fines and want your licence back now you can go to your local court house and request a date to speak with a JP about it. As I've said in other threads, what I've observed in provincial offences court recently is that they JPs are not allowing anyone to use the postal strike as an excuse. They are saying that the onus is still on you to determine dates and do things on time. I would not suggest ignoring the lack of a letter.

Were you charged under a city by-law or were you charged under the HTA for improper use of the high occupancy vehicle lane? If it is the high occupancy vehicle lane you are referring to by the "diamond lane", I don't think city's have the authority to make by-laws about how you can or can't drive in it.

There is a Law Society of Upper Canada bylaw on when you can act for someone without being a licenced lawyer or paralegal. I'd suggest you review it. What the officer means is that you probably could have been charged with careless, but that's not what he charged you with so you can deal with the prosecutor on the charge you are specifically charged with and not what it "could have been". But it's only the local police who have that information. It doesn't go on the province wide system (PARIS) for tracking plates and DLs.

The date of deemed service is just the date by which you are deemed to have been served notice that you are charged with the offence. You still have time beyond that to respond to the ticket by (1) pleading guilty, (2) pleading guilty with an explanation, or (3) setting a trial.

The charge of No Currently Validated Permit is correct in situations like this because Regulation 628 s. 6 says: "A permit for a motor vehicle shall be validated by means of evidence of validation provided by the Ministry and affixed in the appropriate space provided on the permit "

19 months delay is likely grounds for an 11(b) if the delay is attributable to the crown or institutional. Procedure for ordering transcripts varies from jurisdiction to jurisdiction. You'll have to contact them for more info.

If it's been that link it's entirely possible the ticket was never submitted by the officer. But you probably should call the court house and give them the ticket # to check themselves before you just ignore it.

You do both. Usually you file the 11(b) and it is scheduled to be heard the day of trial. So if you're unsuccessful with that, the trial proceeds as normal. If they can't fit it in on the day of, they will schedule it for an earlier date to be heard separately. Again, if you lose then, trial proceeds as normal.

That's probably some branch of MTO. I don't think it's they city's responsibility to erect signs related to the Highway Traffic Act.

The officer doesn't have the authority to bind the prosecutor to a deal (namely dropping the permit charge if you show up with them) so don't quote him on that. Probably not. I've rarely heard of JP's making an issue out of no cross street. But I think it would be even less of an issue with yours, since the specific offence isn't even failing to stop at a particular stop sign at a particular street.
