HI again,
Thanks for the reply. I got a court date for April 14th (134 on 100-259$). I am going to ask for a disclosure, what should I ask to see:
-Proof or radar read
The officer doesn't have to show you the radar reading so I assume they just have to testify that they clocked you at 134km/h.
The officer did not give me my options-is that a ...

Sure sounds like the officer had a great independent recollection of the events...Treatz wrote:He stated that on april 6th at 11:12 am he pulled me over for speeding 74 in a 50. (i was pulled over at 1:12AM, 14 HOURS LATER)

Re: Charged w/ 135 in a 100 zone when i was only doing 115
i was locked into my cruise control at 115 the whole way! i am planning on going to court and disputing this. any help or suggestions??
If you do go all the way to trial make sure to NOT bring this up at court. If you say "I wasn't possibly going 135, I was going 115." because that is still exceeding the speed limit you would be convicted. But ...

This is my 12th ticket in 3 months.
Since then:
"get letter from insurence comp to prove coverage and plead the open liquer ticket down to a lower amount".
He said well you are getting a ticket for a defective braking system.
If i threaten to charge an officer with something, using a firm tone, this to me is not abusive.

Re: Charge lowered by officer-Can JP charge you with the origina
With speeding though it's different because although the speed gets ammended up, you are still being charged for the same offense under the HTA. Whereas in this case the prosecutor would have to lay a different charge at court. In my opinion they should not be allowed to do this but I do not know for sure.

Re: careless ticket
As long as your friend isn't receiving any kind of compensation for it then they don't have to be a registered paralegal.

Follow Too Close = $110, 4 Demerit Points. So you save a couple hundred dollars on the ticket and 2 demerit points but you're still looking at a possible insurance increase.racer wrote: On your first attendance the prosecutor will likely try to get you to plead down to "Follow too close", which is about the same fine, but less demerit points.

Re: 123km/h in a 70km/h
I have aftermarket tires and rims so I assume this would be the difference.
Don't bother bringing this fact up in court.
If you can't afford to hire a paralegal (which I would really recommend doing if you can), you'll want to start by filing for disclosure which will let you see the evidence against you that will be relied upon in court. If ...

Ah okay, wasn't sure if it was a summons or subpoena they would be issued, disregard my suggestion unless the lady who was hit doesn't mind potentially getting into big trouble.hwybear wrote: If it would go to trial the witness would be given a subpoena, issued by the Crown.

Just too bad he panicked and left cause it all could have been dealt with, without a charge. He is paying for the repair and the lady of the other vehicle is writting a letter on my sons behalf to say that he was not driving in a careless manner.. Hope that the judge can take it into consideration when the time comes.

Re: Caught for the First Time
Yes, there are many paralegal services out there that will fight this ticket for you but if you have the time you can probably fight it on your own. You don't have to pay anything extra to request a trial as court costs are already built into the fine itself. Also there are many paralegal services that charge only upon "winning" the case but you ...

Police are allowed to issue tickets on private property, otherwise all you would have to do in order to avoid a ticket is drive into anybody's driveway and you're home free.

Re: Is traffic school offered in Ontario?
It happened to me, I live in Ottawa and from talking to the prosecutor it sounds like they're fairly open to permitting it provided it's a first offense.
