I would assume that he was going into the coffee shop as well. And if he was, that means the handicapped mother would have to return to the vehicle before they left.

This is a very common action among taxi drivers given my observations. In fact it is one action of many that I see taxi drivers violate on a daily basis. Is there no charge though about proceeding through an intersection (past the white solid line) before the car ahead of you has completed their turn?

In driver training they make this safety fact very well known.

You would be notified by phone or in person if you were going to be charged.

Very unlikely though..

Next time: Just let them be.

Your friend should have been smart enough to just slow down and not have let it turn into road rage though because by the sounds of this you guys are use to this...

I agree with Simon. I think he's interpreted that section correctly.

But clearly that is not going to stop an officer from trying to ticket you anyways, as OPS copper clearly shows, he has his opinion and he will stick to it and ticket you anyway, regardless of what the section should actually be interpreted as.

To be completely honest.

If I was the officer I would not of ticketed you if the light did not have a flashing counter.

I would of probably stopped you and made sure you weren't intoxicated and so long as it was an honest mistake then just tell you to be more aware and drive more according to the weather conditions.

I don't have any experience in the court but I have read a lot of threads on here pertaining to fighting speeding in court and it can be done successfully.

In your disclosure request did you ask for the manual of the radar/lidar?

It sounds like he tested the device properly in his notes.

I do not believe what the officer did was wrong. =/

Most officers WILL round down the speed because there is always that +/- range of potential error in the speed measuring device. Usually not anything more than +/-3km/hr error.

So the officer rounded down to 140 even though his radar probably did read 142. There really isn't anything wrong with ...

The Durham Regional police DO have jurisdiction on the 401.

The same as an OPP officer has jurisdiction to pull you over in city limits.

I believe you can still be offered a reduction but not until JUST before trial on the scheduled date.

Can you judge how many car lengths away from the thick white solid line you were when the light turned yellow?

The driver that rear-ended you should most definitely have got charged.
In his mind he knew the light was going to change ASSUMED you were going to run the yellow so he sped up so he could run it too and then failed miserably.

Yea if what the OP says is the true story than this charge is easily beatable.
The only thing that makes me weary of the truth of this story is the evaluator suggesting that it was your mistake meaning I get the opinion that you slammed on the brakes like 1 or 2 car lengths from the white line... which in that case was a very bad idea...

So long as everything you are saying is the truth you were definitely wrongfully charged.

The only way you should have been charged is if you were like 1 to 3 car lengths from the white solid line when that light first changed to yellow.
