Disclosure- Missing Witness Statement

Hello all,

Here's the situation,my uncle who does not speak english got a ticket for failing to stop at a stop sign, because he did not speak english he asked his wife- the passenger who speaks broken english to tell the officer that he "did stop" but when he recieved disclosure, non of that was included in the disclosure statement...so can he use this point to fight the ticket in anyway???

No. A statement by a witness in a collision or to another person in a vehicle is not a witness for the prosecution, therefore no statement was taken.
