pretty much whenever the officer handling the case gets to the file. they took around 2-3 months to give me a call. Unless someone is seriously injured they will not rush anything.

There are a few insurances that offer pretty sweet deals such as discounts part of professional associations or other things. Try TD, Desjardins, Sonnet or State Farm.

Fight it. I don't believe he can just charge you with something else in court. It does not hurt to ask for disclosure and a trial date.
You can always plead guilty at the time of trial if you do not wish to fight it at that time. So you will not lose anything by requesting a trial and asking for full disclosure and it is to your advantage.

Re: careless driving because pedestrian claims my car hit her
Hi Everyone,
Sorry for all the questions but I was wondering if someone can tell me how I can order a court transcript of my traffic charges I fought a year ago and got them withdrawn. I am hoping this transcript can lead to some kind of evidence that can discredit this woman and her accusations so she does not win any settlement from my insurance.

Re: Starting a new insurance policy
It is very common they do a check during ever renewal. But obviously from a business stand point it can get very costly to do a check on ever policy holder. So usually they will go for red flags but even if you are a clean driver there is still about a 50/50 chance they might just do the check anyways a company procedure.

If you never had your trial yet, then your driving abstract is clean because you have not been convicted of the offense yet.
So no when your insurance company asks if you have ever been convicted of a driving offense in the last 3 years you tell them no. On your next renewal if the insurance companies request an abstract they can see when you ...

Well I just want to put this behind me and not think about it anymore. Too much of a headache. But just for my own knowledge can't I sue her for like not showing up to traffic court to dispute my 3 charges I got withdrawn back last year. For wasting money on a paralegal, time off work etc.

Re: careless driving because pedestrian claims my car hit her
Got a call from my Insurance lawyer saying that they have been hired by my insurance company to deal with this matter. I think they wanted to go for like $2 mill or ...

My insurer uses an app that monitors your driving and if you get a good score they give you a discount of up to 25% (You will never get this unless you get 100%) on your next renewal.

Re: careless driving because pedestrian claims my car hit her
You'll have the opportunity to cross-examine her over the inconsistencies. Of particular note, you'll be able to go after the fact that she told the officer she'd been released from hospital without injury. She'll have to show that she actually has a hospital record. You may have to summon the officer to get him to testify as to what she said.
I ...

Re: careless driving because pedestrian claims my car hit her
Normally in a civil suit the onus is on the plaintiff to prove negligence. However when it comes to an accident between a vehicle and pedestrian the plaintiff does not have to prove negligence due to section 193 of the Highway Traffic Act:
193 (1) When loss or damage is sustained by any person by reason of a motor vehicle on a highway, the onus ...

It sucks that this thing has come back to life. The fact that she has switched law firms is completely irrelevant. She may have found a different firm she prefers. Also, the fact she did not show up for your trial is likely irrelevant. Of course, if a lawsuit ever goes to trial, you or your representative can question her about why she didn't ...

In the past, I've just sent in a letter (by mail or fax) to the courthouse - something along the lines of what I attached below.

A justice can dismiss a charge if:
- the prosecution does not appear at trial
- the prosecution offers no evidence or insufficient evidence at trial
- the defendant is found not guilty at trial

Yes, you can request a transcript of the hearing. The transcript will likely be short and not cost very much money.
Alternatively, you can request for a "minute" from the court in accordance with section 62 of the Provincial Offences Act :
" Minute of conviction

Make sure you instruct your paralegal that you will absolutely NOT take any kind of plea deal. Send it to them in writing, both by email and by regular mail.
Just my opinion, but I would suggest that in this case you DO need to go to court and testify your side of the story as well.
Sounds good. And yes I will have to go to court and testify ...
