well thats an interesting perspective. i have learned too that whatever i decide to do about the ticket i certainly am polite with the officer at the roadside. and to be honest i dont think the officer should reduce tickets at the roadside! if you are speeding then you are speeding end of story. all im saying is that for the "lay" person who is challenging the charge it seems like the system is stacked against you. i dont know if thats the case with paralegals or lawyers but i dont think so. so it all comes down to education and training..... and thats why we are all here right? to e...

it just seems that the prosecutor puts off anyone who is pleaing not guilty. we are always put at the end and ive had to wait for hours while they deal with everyone else.

yet someone who is pleaing guilty is in and out in a few minutes........

also trying to intimidate the uninitiated with........."well the ticket was reduced at the roadside and we are going to ask for it to be amended to the original speed if you are found guilty".........

pure intimidation!

anyway just my thoughts...

are we being treated unfairly because we plea not guilty?

ive had some experience recently where i feel the prosecutor and/or jp are discriminatory towards people who are not pleaing to lesser charges and actually want to go to trial. has anyone else had this experience? what are your stories?

thanks for the advice.

i went to the court today and had the appeal reinstated. do you think i can use any of this as part of my "defense"

-had to wait 4 hrs in court and they did not get to me, they were proceeding with people that had appointments 2hrs after mine!

-still need further disclosure.... they say they have nothing further to disclose...?

thanks.

sorry i missed this part;

Hopefully there will be something in the manual that will prove helpful. If they refuse to give it to you, that's another reason for staying the charge. There's lots of case law out there regarding that, let us know if you need the links.

yes i would like the links that have reference to the disclosure.

thanks

thanks for the reply.

i was charged in october.

i see what you mean. he did say that he would make my case a priority at the next trial though. in the meantime im going ahead with further disclosure requests. they provided me with a copy of the manual but its not the full manual, its from daytech services here in canada.but there is a mailing address for laser atlanta in atlanta.

so...

can i request the full manual?

how do i do that?

can i request a copy of the actual police training procedures for this laser?

thanks again for the help!

and also thanks for this " If there's some part of the manual that says "don't aim it here" and that's where he aimed it, you could question the validity of the reading; conversely if it says "for motorcycles, aim the LIDAR here" and he didn't, you could also question its validity... unfortunately I don't know if it does/does not... Ask for a copy of the parts of the manual that deal with testing and operation of the device (if you haven't already) as part of disclosure. This should tell you more. " radar identified, i went right to the disclosure office and reque...

update!

so i went to my trial with the intention of asking for an adjournment if the officer was there and to go to trial if he was'nt. i got there on time but i went out to use the washroom while the prosecutor was going through his list. maybe 5 minutes later i went in and the justice was there, the court had started. i saw that my officer was there so i was going to ask for an ajournment. the prosecutor went through his list of "plea bargainers" and they had one trial, it was a woman who was ticketed by the same officer as me, so i at least got to see him go through his testimony. after t...

prosecutor did not get to me, had to leave.

i was at my appeal 9am court, i had to work at 2pm so i figured i had enough time right?

wrong!

i was in court for 4 hours and then i had no choice but to leave to go to work. i had clearly stated to the prosecutor during recess that i need to leave by 1230 for work at the very latest and he said that he would get to me right away after the recess.

the recess finished at 1130 and i waited for him to call me until 1pm! i had to leave then or i would have been late for work.

what can i do?

i had a fire route ticket this year and i went the full monty with that one, i went for a first attendace and the by law guy was a real bastard, so i requested a trial and ordered disclosure, they never provided it or sent me a conviction notice so im assuming that they abandoned it, maybe they are not used to disclosure requests for parking tickets!

if everyone who got any kind of ticket tried to fight it the system would break down!

lets spread the word and convince people to stand up for themselves!

if its just a waiting game then its worth using all resources dont stop when you get the disclosure, read through it and look for things that you need further disclosure on 1) manuals and testing procedures 2) officers training 3) unclear notes i think that its important to make them work as hard as possible for your conviction. i have had adjournments for disclosure related issues before. for the offences you already have ; for the actual conviction stays on your abstract for 3 years from date of FIRST conviction, and for the points its 2 years from date of OFFENCE. and also if you are convic...
