I've been trying to figure out who decides what cases become listed on services such as CanLII. I see that the court publishes certain cases, and CanLII lists them. the CanLII FAQ says that they don't choose them, they just publish what the court publishes.
Can ANY past case be used as case law, or only the ones on CanLII and similar services. Who ...

Re: Pacing
Well the OPP officer that ticketed my wife clearly did not do it even once that day. Skill, attitude and diligence varies greatly from police force to police force, and even from cop to cop.

Re: self-testing devices
In my profession, (medical/lab/pharma equipment technician) an internal test is NEVER considered proof a unit is correctly functioning. It must pass both internal, external and sometimes process challenge. If any one fails - it's no good. I am qualified by NIST (National Institute of Standards in Technology) as an instrumentation calibrator, so I ...

Agreed. Hound them for that manual unit they show it to you, or ask for a stay.

Re: NEW Lidar Defence
How does this work though? A radar detector it not illegal to possess. If I want to sit out on my front lawn with one in my hand, I am not breaking the law. Only when one is driving a vehicle that is equipped with one, is any law broken. He was in court with the device, and not in a vehicle at the time the charge was laid, therefore he did not ...

Re: Pacing
I beat a pacing ticket my wife got. The trial was earlier today.
My defence was that the officer did not test the speedo on the day the PON was issued.
My line of questioning was like this (paraphrased):
Me: Have you ever used radar or lidar in your duties as a traffic enforcement officer?
(Prosecution objected - this case does not involve ...

Re: The MPH Bee III radar gun's POP mode
The reason why a POP obtained reading is not good evidence of speeding is because it is prone to inaccuracy.
POP is mode that emits a very brief (67 millisecond) pulse of radar to determine the speed. Its meant to defeat radar detectors. It works because the local oscillator sweep (the "tuner") in most detectors, (especially cheap ones) is too ...

Re: Triform using cheaper cows?
The company I work for (medical equipment) is slowly sliding down the cheapness scale. Manufacturing has gone from Canada (1940-1970), to US, (1970-2006) to Mexico (2006-Present). The competition went from USA to China a few years ago.

How to bring up a point in court?
I will be defending a pacing ticket that my wife got a few months back. I have requested and received an (incomplete... I'll deal with that later) disclosure. Nowhere in the the disclosure does the officer indicate that he made any check of his vehicles speedometer. (No verification before or after by any method at all.)
So, what do I do in court ...

Re: "Reduced" speeding ticket
What is it that prevents them from doing so? I've always mistakenly believed that they could amend the charge or something.ticketcombat wrote:They can't raise the ticket back up to the original speed limit.
