Does the prosecutor have the authority to take the charge away? Or would they need to consult the Officer.

I was given a ticket for an improper right turn on York from Front st for turning right from the left lane in 2009. I was actually turning from the right lane, but had to make a wider turn to avoid the pedestrians at the very busy intersection. I have my court date in a couple of weeks time.
