Redlightcamera: light was only red for 000.5 seconds
Hello I recently got a red light camera ticket, which I sent for early resolution. The first picture showed me behind the solid white line (where most cars stop), and the red light was only red for 000.5. The second picture showed me in the middle of the intersection, the light was red for 001.2 secs. I was doing 71 in a 50 (weber st in waterloo). I was busy on a delivery (Im a student that delivers food). I guess there is no disclosure, but what are my options? I mean the light just turned red, it was only red for a for 000.5! Defense? So had the trial what do you want me to do or say? ( I already had the early resolution meeting ) I will plead guilty, and then ?... What happened at your early resolution meeting? Before you trial, they'll try to resolve it again. If there's something to offer, they'll offer it. At that point it'll be your choice whether or not to plead guilty to whatever they are offering. If you need more time to pay the fine, they'll give you more time. From my vantage point at a range of approx 7m, I noticed the driver was not wearing a seat belt. I observed that the driver was wearing a white t shirt with a design on the front. I noticed that the chest portion of the t shirt was unobstructed by seatbelt straps, and as the car turned into the station I was also able to observe through the rear window, both straps of the seatbelt hanging parallel and vertical beside the drivers left shoulder and the buckle to the seatbelt was visible. Saw the Justice of the Peace today...
Early Resolution is not a trial date so you don't need an adjournment. When you get to meeting, the prosecutor may or may not offer you a plea deal. I would recommend you just say something like "I would like some time to review disclosure before I decide what to do." The prosecutor may have disclosure ready for you at the meeting or may have to set in motion the process to get it for you. Most likely the prosecutor will also set the process in motion to set a trial date. Then usually when you show for your trial date you will have a chance to meet the prosecutor and if they previou...

You know something I checked my outlook, and I sent a request for disclosure for this charge....but noticed that they did not even send it (searched my Inbox).

These are all important questions that you need to consider when cross examining the police officer to try and bring reasonable doubt to what he said. And as well you would say what ynotp says above.
Daytime, No tinted windows but was wearing a white shirt.
Can't find my disclosure, but ** I think** the police was behind me when I was turning at the intersection..

Hi there, Unfortunately, I can not find the disclosure (which I am sure I sent a request for), and I know without it there is little this board can do for me, but I will tell you exactly what happened: I was delivering a pizza and realized that I was low on gas, so I pulled into a gas station, as soon as I got to the pump, I see a police car behind me. I was certain I had my belt on, but of course the constable's word was different. He mentioned he saw me in the intersection, without my belt on. I was wearing a white t shirt. What are my defenses? If the officer doesn't show up, they usually do withdraw the charge. The disclosure looks pretty solid so my recommendation would be a plea-bargain. I don't think "defence of necessity" applies in this case, because they will simply say that you were either driving too fast for the conditions, or were braking too late, and the JP will convict. You may be able to plea-bargain it down to something like "fail to proceed as directed," or "fail to obey lane light." Both of those are a lower fine, and from a licensing standpoint, they are 0 demerit points. If you luck ...

Hi everyone, So this past winter, I slowed down to make a right on a red, but decided not to stop because I was afraid the car behind me would hit into me, especially since the roads were wet and slippery; braking distance would of been longer. There was an oncoming police cruiser (bad luck usually there are not police in this area), he quickly pulled me over and gave me failure to stop at red light.
