Its another offence to drive in Ontario under the jurisdiction of another licence when your Ontario licence is suspended.
You need to come to grips with the fact that you are in all likelihood going to jail for a period of time. Running away only prolongs the inevitable.
You should start making smarter decisions.

"Winning" an appeal is one thing, getting off because the Crown didn't want to contest it is another completely. Besides, this is provincial offences court. No precedence would have been set.

You do not get your licence back from the police. If it was suspended for a warn range suspension, it gets returned to the MTO. Once the suspension is over, you have to pay a $150 reinstatement fee. The MTO will then issue a new one.

I said I would like to motion for 11(b). He asked me what is the reason. I said that it has been 14 months delay from the date of charge and due to no fault of my own and that my right for being tried within reasonable time has been infringed. It is partially your fault. If I understand your info that you provided, you were not ready to proceed at trial on at least one occasion. That means that some of the delay is your responsibility. You're not telling the truth. There is no way possible that you had a few sips of wine and a beer, then an hour later, blew an Alert (which means you had between 50 and 99 mg of alcohol in 100 ml of blood). It is next to physiologically impossible.

Demerit points are administered by the MTO. Police, Crown and JP's can't do anything about it. We don't set them.

It's an average of 0.015 mg/% per hour. Some people are slightly lower, some are slightly higher.

It is not immediate either. It can take a few days to show in the system that your licence is no longer suspended. So do not expect to pay the ticket at 12:00 and be good to drive at 12:01.

All the prosecutor is required to provide you is the cover page (so you know what device it is) and the testing procedures. They have discharged their obligation for disclosure if they do that.
