It was not even a case the Judge just do not care, they think that I am insulting them by going into court with parking ticket plus I did not want to plea guilty...Can you argue with the Judge? I would like to share my story here. I have got a parking ticket ($40) about 11 month ago and went to court with it. I never was going to cort with parking tickets and this time it was a principal matter for me as there were no parking sign. My car was parked just 3 meters from the stop sign at the end of the road (you can see a post office box there). Toronto speed limit for cyclists
I know that there is no demerit points for cyclists, but my question is how do I know what is my bike speed? How the police officer can prove that I was speeding? What is the ticket value for this offence?

Does it mean that I should not get any ticket while on unicycle riding over the speed limit? As unicycle is not a bicycle!

I guess you can, read my case-Unfortunately you can not sue the other driver directly for damages. Read section 263 subs (1) and (5) of the Insurance Act.

I was disappointed with the small claim court judge decision yesterday. Judge ruled out - 25% driver's fault and 75% my son's fault. The explanation was simple- car driver was negligent, as he did not see any pedestrian (bike) on a sidewalk and my son was negligent as he did a very unusual maneuver to pass the car on the right and did not pay any attention that car was signaling...There were only one witness who confirmed that he have seen that the driver was signaling. Even we know the signaling itself does not give the right to turn…I still did not get it how it is possibleâÂ...

Any word from the crown or court regarding your appeal? Just giving you an update, the downtown court quashed "fail to report" charge on March 5 and now we are at the same point as we were originally- having an original charge. Therefore it looks like courts do whatever they want even s. 85 of the POA conflicts with s. 8 of the regulation, thus, s. 85 of the Act governs. The court should not not grant us an extension of time to file an appeal after 15 days period is passed. Reopening the case does not appear to be available either. But court did it. This should give me the opportunity to request my $500 from this traffic tickets company who misrepresented me. No, i have not heard anything... I sent to crown today the registered mail. Everything you posted changes everything, in my view. You son wasn't riding o the sidewalk, he was riding on the road. When the car turned he steered to the siewalk, but he was riding on the road. Are you saying your son wa on the sidewalk at least one driveway before reaching the drviers driveway where he was hit? Why a cyclist would turn to the sidewalk if he/she would 100% sure that the car will turn next moment and he could collide? He saw a car ahead of him, which started decelerating without signaling. Unsure of the driver actions, he turned to the deserted sidewalk on his right hand side. He continued biking until the vehicle sharply turned right into driveway without seeing him... My son was already on the sidewalk before the colision happend as he turned there (car driver was slowing down).
Should I accept at this point the cheque from the insurance company or ask to provide me a lawyer?
Variant A. During this conference it turns out that my insurance company is ready to pay for this damage, in this case two sides might accept the settlement...
Variant B. The settlement is not reached and we lost (worst scenario) this case with or without insurance company lawyer. Do you think they will recover our loses?
