i agree that most human beings could figure it out....but it's the principle....the ticket should have been complete, allowing in my opinion an major part of the violation blank just means, oh here's a ticket, you can google it and find your answer. the ticket, just you're notice of assessment, or your MPAC property assessment are standalone documents.....they all tell you the information (what you are being asseessed at) and according to which section of which act and of which act. the whole point is that any layman could understand these documents without needing to employ a profession and n...

so i went today... first met with the prosecutor outside the court....who just laughed at me when i said there was a flaw, she just said to wait for the judge got called up to court, at first the judge said it was all complete, then i showed him my copy and we all went into discussions...all the prosecutors were helping each other look for sections and court cases, while the judge was doing his own... stood there for awhile before he called a break... 30 mins break, went back at noon.... came back with two court cases 2017 wadood (wadude?), in which it allowed the cop to make minor changes 199...

going to appeals court this friday.
the plan is to tell them I don't have a complete ticket as the act is not filled out. I do not work in the business, this is my first ticket and have no idea how to prepare a defense without complete information. For me to have to jump through hoops to try and figure something out on my own, that should have been correctly complete by the police officer is not fair.

so i went to court i filled out the notice of appeal form, i put speeding as the offense and when is asked for the section i put N/A :) then i gave the clerk a copy of my actual ticket and payment receipt from the morning, so they can see the section is blank she then filled out another form, and she put HTA on there and gave me a date for oct 6, 2017. Now we sit tight and wait. I will re read this thread with all of your advice and guidance before I go, just so I hopefully can familiarize myself with some of hte case law and sections. but i'm really hoping it will be as simple as: the ticket ...

went today to the traffic court. asked for an appeal, she verified if i wanted an appeal vs re-opening. I said appeal she made me pay the ticket she provided me the certificate of offence as 'part of the package' she provided me a blank yellow form i didn't realize that appeals court is somewhere else - and she didn't tell me where either? which one would be closest to me in Mississauga? the yellow form asks for: 1. ontario court of justice at: 2. appelant is: defendnant/prosecutor/attorney general 3. name of appelant and address 4. counsel for appellant and address 5. name of respondant and a...

when I ask for a copy of the original certificate of offence, is that from the clerk? or the side where we request disclosure? can I still file the disclosure form?

april 13, 2017: i received my conviction in my mail due for may 3, 2017 (57.50)
i don't see any notes on how to file an appeal on this document that i received.
I'm assuming I have to go back to the courthouse and ask them for some appeals form? is the appeal done on the spot or do I have to wait for a date in the mail?

this is exactly the how the scenario was playing out in my head
i'll come back and keep this post updated with play by play.
i'll put it in my calendar to call about the ticket 30 days from the day I received it (feb 17), or should I call in 30 days from the expiry of the 15 days (therefore, 45 days from feb 17 - day I received the ticket)

I completely understand it wouldn't show speeding, but how many acts is one to explore until they find the right one?

I thought it was fatal.
I've read that even if the officer states HTA - it is not correct. It should always be spelt out at highway traffic act.
As of right now, I could be looking at section 128 of the Income Tax Act, the Excise Tax Act, the Ontario Assessment Act, could be anything.

Speeding ticket with fatal error?
Received a speeding ticket in a construction zone. Officer reduced the ticket to $52.50 doing 15km/h over the posted. ticket shows the following: Did commit the offence of: Speeding, 65km/hr in a 50 km/hr zone, construction zone contrary to: (this has been left blank) section: 128 I've read some threads on this forum and some other sites and I take it that this is a fatal error (not stipulating which act is being followed) I've chosen to follow an option not listed on the ticket...which is sit back and do nothing. Assuming the officer has not corrected his version of the ticket and they notice...

So i got there on time, received my discloure and it had everythign I requested except for a typed version of teh cops notes...
they started doing attendance in the court, and when i went to teh prosecutor and stated my name, they already knew the cop wasn't going to show up, so they just told me 'okay thanks' have a seat'
so all in all...cop did not show, ticket dismissed...
but this is my 2nd time to the barrie court...and both times...they were rushing to get ti started...and they started 30 mins late both times...annoying

okay i'm abit confused again: a) talk to the prosecutor, say non guilty, see the offer, and accept or reject b) if rejected the offer, i'll get called up to the stand c) cop isn't here, case stops, cop is here, we proceed d) request a stay based on the fact that you have only received disclosure (At that point of time) yesterday.
