will disclosure always tell you who will appear as a witness..I requested disclosure and all I got was a photocopy of the cops notes, and the accident reports...at this point I don't really know if they have any witnesses beyond the cop that issued me the ticket?

thanks hwybear..the officers only recollection of the incident will be from referring to his notes. If his notes do no correspond with the official accident reports, would that not cast some doubt on his recollection of the events.? I am quite sure they have no witnesses who can testify that they actually saw and recall my lane change...that will be taken only from my statement I gave to the cop after the accident.

so when I asked for disclosure, should I have specifically asked for a list of any witnesses? I assumed that would be a given but only got copies of accident reports and the officers notes? Is it too late to go back again and ask for more disclosure, or better to question at trial why further disclosure including witness names were not provided at the first disclosure request?? My main issue is why I was charged the way I was...unsafe lane change does not make sense given the circumstances, car 1 hit from behind, car 2 hit's car 1 and is charged with FTC and car 3 (me) hits car 2, and I am cha...

chronic accident locations

i am trying to find out if there is any central repository for collision locations within Hamilton Area...I am trying to argue a case for a poorly designed exit ramp from the 403, and although I have heard anecdotally that the exit is a trap for repeated accidents and collisions, I am not sure where to find actual accident records that would support this notion. I have tried emailing the Hamilton Spectator but they have not replied to my request for information. Any suggestions?

disclosure and witnesses

i was charged under sec 142(1) HTA in a 3 car collision. I requested a trial date and disclosure. when the disclosur documents arrived included was an application for an adjournment due to the officer being on training course during the scheduled trial date. I assume a new date will be set further out? When i reviewed the disclosure docs it included accident reports, statements from the 3 drivers involved and photocopies of the officers notes. the officer has mixed up the drivers and their vehicles in his notes. the accident report names D1 D2 and D3, as well as V1, V2 and V3. it was a 2001 Ford Focus I think, it got damaged both front and back, probably a write off, the car she hit from behind was also a Ford, newer, like 2004..

racer, just another thought... :?: you seem to know the exit I am referring to well, and if what I am hearing about how cursed this exit is, would there be any value in my researching and documenting the volume of MVA's that occur at this same location, and that this might give some weight to claiming this is not a safe exit... :?: just thinking out loud.

what I am saying is i did not knowing move into a lane where it was clear to me as I made the lane change that traffic was stopped...the lane change was made well before the accident, but on the curve in the highway (and a dip under the overpass) and although it became clear to me after completing the lane change that traffic was braking, i would not have moved into that exit lane had i thought for one minute that i was not going to be able to stop my vehicle in time. how to request a trial date?

if my ticket is issued in Hamilton and I want to request a trial date, can I go to the Provincial court office in my home town of Milton to request a trial date? i never go to Hamilton and would prefer not to just to appear and request a trial date...and request dislcosure.

thanks racer, I wasnt sure how to post so not surprised I am not. in the right place..the charge relates to the lane change...he did not witness my lane change, but my statement says I had just made a lane change into the exit lane when the accident occured...you are exactly right, I was exiting the 403 at York Blvd (coming from Milton) at about 8:10 am, clear day but very bright sun, he concluded that i did not make a lane change "in safety" because i entered a lane where I was not able to stop my vehicle in time. Traffic was very heavy and dead stopped at that exit. I saw the brake...

the ticket says Section 142 (1) and he specifically told me he had the option of charging me 2 different ways, one which carried 3 demerit points and this one that carries 2 demerit points (like he was doing me a favor). Actually i have been reviewing your site and the step by step instructions...very thorough but a little overwhelming for someone who has never been through this before. I think my original hope was to get a lesser charge with no demerit pts thinking those are what will affect my insurance, but the more I go over in my mind the events of that morning, i really don"t believ...

need help -unsafe lane change?

I was involved in a collision a week ago and the OPP wrote me a ticket for "Change Lane, not in safety" and he told me it was 2 demerit points...I can find no mention of this in any online HTA material? I want to fight the ticket but not sure how to do this...so looking for someone with some experience to chat with.
