Ask the prosecutor to amend the charge to "Fail to Turn Out to Left to Avoid Collision – Section 148 (5) of the HTA – Set Fine = $ 110 " It carries 2 demerit points and I have seen this amendment many times.

Friend charged with Careless after an accident in which they fell asleep at the wheel, crossed the center line and hit another vehicle head on, and one other vehicle swerved to avoid the accident and rolled over in a ditch. All three vehicles were write offs, and one person was taken to hospital with bruised ribs and a broken collar bone. Was presented a ticket with the Careless charge and a summons to appear to set a trial date. Went today to speak with the prosecutor prior to setting a trial date, and she agreed to amend to "Failure to drive in a marked lane", 154(1)(a). Told her I...

If you have disclosure, on the day of trial, when signing in tell the prosecutor you want to speak with the officer to have them decipher something on the disclosure you cant read before you decide how you want to proceed that day . If they call the officer then you know. Otherwise they will be up front and advise the officer is not there

Had my scheduled trial date today in Mississauga for 1:30 PM court. Had already received my disclosure and was going on the chance the officer would not appear. The court listing showed 52 charges to be heard, with about 40 defendants all in the same court for 1:30. The court opened at 1:15pm and all those having matters before the court were asked to present themselves to the Crown. OPP Constable Alexander Smith was issued a provincial offence notice for an unsafe "start from stopped position.".
No demerit points. Me thinks John Q. Public would have a Careless Driving charge applied, as how can you not see a big yellow school bus?
Charges were only laid after public outcry as initially the statement was no charges would be laid.

Has ANYONE ever had their ticket amended up in court?
Keep hearing about the right to amend a speeding ticket UP by the prosecution if you request a trial and the ticket was reduced from the original alleged speed, when the ticket was issued. Has anyone really ever had/seen this done. Every time I have heard this threat, it seems a deal is reached prior to actual trial and the defendant pleads guilty to the ticket or another reduction is allowed to amend the ticket even further down for plea of guilty. Courts seem to be just paper processors these days with those in attendance for a trial accepting a plea and nothing goes to trial despite the off...

Go to court and hopefully you know what the officer looks like to see if he/she is present. If you don't recall what he/she looks like, tell the prosecutor you want to speak to the officer prior to court being in session and they should point the officer out if they are there. I have noted that the prosecutors never divulge if the officer is not there hoping you will plead guilty without asking for a trial. If you suggest you want to plead not guilty they will hold your case till near the end of the court session then call it up and advise they have no evidence to offer in the case.

Both officers must attend to provide their statements, the officer who obtained the reading on the radar unit and the officer who issued the ticket. Dwell on if they lost sight of your vehicle from time of radar reading to time the second officer pulled you over. Being as it was very dark you may have some credence as to identifying the correct vehicle.

Surprising as most times the prosecutor gets you to plead guilty to the reduced charge and never informs the court that the officer is not there. No need for the officer if you plead guilty to the reduced charge.
