I was thinking the same about the "lateral property lines" reference as well, honestly, but I stumbled on some possible case law. I'm not sure it would apply because it was regarding a different offence but in R. v. Green [2004] the court found:

hey there, what does a suspended sentence mean with regards to speeding ?

"A suspended sentence is a legal term for a judge's delaying of a defendant's serving of a sentence after they have been found guilty, in order to allow the defendant to perform a period of probation."

So your on probation, so if you commit another offence what happens ...

I'm sorry to double post but I'm also surprised the justice didn't ask for submissions as to penalty, he judged and sentenced in one fell swoop.

Very interesting! Congrats on winning on appeal. I've been looking for transcripts as a resource, especially when it comes to speeding charges. I've defended myself in Brockville, too -- against the same prosecutor. I can't say I won :P I got a suspended sentence so it could've been worse. Curious about what you thought of the prosecutor at trial ...

I am mostly opposed to giving in and paying tickets, but then again this one is only $6 !!!

Haha, I know. I feel a little petty trying to dispute it but, hey, it's my day off. :P

I've been e-mailing the Toronto Parking Authority and they've pretty much said the same. It's not the $6 that gets under my skin, it's the lack of appeal or dispute ...

Thanks for getting back to me, guys. I saw that post on redflagdeals, too. My only concern is that the Toronto Parking Authority is city-owned. If it was a private parking company, I'd have no hesitation ignoring it. :P I don't think it's a big deal if I don't pay, honestly, but I don't like this using up my "grace" parking infraction before they ...

The officer didn't say except to mention the witness and complaint but yeah it's s. 140. Reading it it seems like the absense of oncoming traffic might work as a defence but I really don't want to provoke something more serious.
