Invalid Ftr Ticket, Issued Summons Instead

Unread post by BioGirl23 »

I need advice and help.

I have been issued a failure to report ticket for something that has occured in May, and the ticket was issued on June 5th

The next day, the police officer calls me and tells me that I should throw the ticket away, as it is written more than 7 days since the offence has occured, and it is her mistake. Instead, she will be issuing me a summons to court instead,

The officer told me that it is for the SAME charge and SAME fine, but I understand that summons do NOT have set fines. Does summons mean facing a more serious charge? I will speak to my lawyer as soon as the summons arrives to have the details on the table, but I was wondering if anyone else has faced this kind of situation?

Any help would be greatly appreciated

Nope, you are not facing a more serious charge. A Provincial Offences Notice (traffic ticket) has to be issued fairly soon after the offence, but they've got a longer time frame for the Summons. If they can't issue the ticket soon enough, they issue a Summons.

* The above is NOT legal advice. By acting on anything I have said, you assume responsibility for any outcome and consequences. *
