Charged With Failing To Yeild

I was waiting to pull out of a private drive to make a right hand turn into the first lane. The on coming car had it's indicator on to enter the same drive, but when I pulled out I was hit. I was charged with failing to yeild and was told that it didn't matter if the signal was on I was still at fault? Is this true or is it a beatable or lesser charge to be had? Not looking forward to losing the 3 demerrits.
