Need Help With 2nd Change Of Trial Date Motion By Prosecutor

I had a trial date in barrie for speedin in december. 2 weeks before trial i get a moition to change trial by prosecutor as OPP officer cant make it cuz shes in a training course that day. I attend the motion, argue to throw it out, they instead give me a new court date for march 15th.


Today i receive letter from city of barrie again notifying me of a motion to change trial date because the opp officer is in training again on march 15th.


Is there any way i can get this thrown out of of court, this is ridicilous to have this trial date changed twice already.

bottleboy: what was the date of the infraction?

The delays you describe have not been your fault and were caused by prosecution. YOu should be in good shape for an 11b Charter challenge depending on the date of the charge.


Have you requested disclosure? If not, do so now. If they don't give you dislcosure in time for the court date, this will only strengthen your challenge. Delay and failed disclosure would be a powerful knockout punch!
