Can I Request Adjournment To File An 11b?

hi all, great site! I have been looking for an answer to this, and pretty much read all 36 threads pertaining to my question. having just found this site my trial is may 30th 2011

offence (seatbelt) offence date april 26 2010 which is 13 months 4 days. as of today it is 13 days to trial.


should I file for disclosure? Should I start the 11b proccess or should I go in and ask for an ajournment to give the crown the 15 days plus they will need? Trial is on markham rd.

I have no convictions and the officer was cool, I was distressed at the time and he suggested I get the seatbelt fixed by my mechanic, and he would drop the charge to drive vehicle

with improper seat belt, which carries no points

13 months should get the charge stopped at Markham Road. You can request the adjournment, but be prepared to explain why. This will also stop the 11B clock at 13 months and 4 days, but that still should be enough to get the charge stayed.

just wanted to drop in again and thank you for your advice, as it turned out the officer did not show! Sorry for the not getting back sooner as I hate it myself when I read some ones story and do not get the end result.
