The sergent said he "had to charge me with something" and gave me a ticket for failing to slow down and leave room for an emergency vehicle.
Probably is s. 159 (2), formerly 159.1 (1)It would be helpful if you posted the section number under which you were charged.

Certainly, not the right comment from a prosecutor. He would have to prove the offence beyond a reasonable doubt.I went to court and when I explained to the prosecuter that I felt I did everything in my power to try to obey that very law and everything I could to avoid the accident I was told none of that mattered because "you still hit the cruiser" and that both the officer and the sergent were present and if I tried to fight it in court based on that argument I "would be very sorry."
Have you seen disclosure? If not, ask for it and review it. That may help with you decision.He offered me a lesser charge of leaving roadway not in saftey which is a $130 fine and 2 points (the points are what worries me). My question is do I have a chance of fighting the original charge in court based on the road conditions and showing due caution or do I not have much choice but to take the lesser charge.

I think this is a valid point. It's easy to misinterpret waving hands on the side of the highway. I know if I saw a cop looking at me and waving his hand, I would fully believe that I'm being pulled over.I was 200 m away from his car when he waved me. I was just about to change the lane, but thought he wanted me to pull over, so I slowed down to 45K, but did not change the lane as I had to pull over.
Actually He did not waved me to pull over, by waving he wanted me to change the lane.
I only could not understand his signal.

When the officer stopped me, there were two emergency vehicle on the road. In the witness box he checked NO.
Is this a question, why didn't he use other officer as a witness?

If you did that he might of thought you were going to run for it.Do I require to change lane and then come back again on right lane and then pull over.

To add to that, there is no way of knowing if said vehicle will suddenly pull back onto the highway without looking. If people can make sudden U-turns in front of transport trucks they can pull out just inches in front of speeding cars. If I see a stopped vehicle, I move over. If you're looking ahead, there's always a gap to find and time to move into it. Had to do that a couple of times heading through the Chatham/Kent area over the weekend, including for a stopped cruiser at the 122 km marker.Even if it was not a law, common courtesy and defensive driving should be thought of and move away from anything on the shoulder.
