Trial was set today at 9;30,

Rather optimistically since prosecutors, secretaries, and judge didn't role in until 10:15.....

it took 2 hours of my time and a couple of No Deal replies to the prosecutors but I had my moment and "Case Squashed" uttered the judge!~

You too can fight traffic tickets by following prescribed steps,

and remember when the prosecutor says "Wanna Talk?"

say" No Deal!"

Hi Joepenoso


I've been following this post pretty closely and your responses has been very helpful for me. My appeal trial date is this Tuesday April 14th and I'm really really nervous as I'm not even sure how court works... if it isn't too much of a hassle, do you mind explaining to me a little how the whole process works? I'm not even sure what to say other than the fact the Justice errand the conviction by section 9.1(b) of the POA act and that the conviction and sentence should have been dropped in the first place.


Also, why was your license suspended if you decided to appeal the charge in court?

I phoned courthouse and it appears the Superior court messed up and stated unpaid fines were due when case WAS QUASHED. Courthouse said they fixed the problem Friday but will see Monday when I renew license.[

Wow... sounds like a never ending process. Hope it all gets sorted out for you and I hope I'm as successful as you in court Tuesday.


Thank you for posting the follow-ups regarding the process from start to finish on this thread. Makes me feel more confident I'm able to get my ticket quashed too.

Short story short: trial set for today at 2pm in Owen Sound...


1:50pm: The prosecutor introduced herself to me in the hall before we entered the courtroom and tried to talk to me about the case. I wasn't too sure if I should say anything outside the courthouse so I told her anything I wanted to discuss would have had to be inside the court room. No Judgy, no talky.


2:01pm: they called me up, the prosecutor opened up and said the quantum of the fine did not match the offence and that the ticket should be quashed as I was misinformed of the infraction.


2:04pm: The judge agreed, allowed the appeal and quashed the ticket.


2:05pm: They told me they would reimburse me of my payment in full


2:06pm: I smiled. Nodded/bowed (didn't know that was a thing) to the Judge and walked out


2:07pm: did a happy dance and drove 2 hours home



Thank you EVERYONE on this thread for helping me through this lengthy process. Thank you for informing me of the process and experiences you have gone through. I owe much of the ticket quashing today to you guys who have helped me understand what the heck was going on.
