Any tips on combatting this ticket? I requested a trial and disclosure. They provided typed disclosure. The officer was wearing a body cam and I had requested disclosure for that as well but that has not yet been provided.

The offence was Sept 2024. Court date is scheduled for December 2025.

NOTE: DRIVER BECAME A SMART MOUTH WITH THE WRITER AS HE WAS REQUESTING A CAUTION

DRIVER THEN WANTED TO SEE MY CALIBRATION ON THE SPEED MEASURING DEVICE- OBVIOUSLY

UNEDUCATED AS THE WRITER DOES NOT CALIBRATE THE UNIT. AT THIS POINT, THE WRITER

DISENGAGED WITH THE DRIVER BASED ON HIS ATTITUDE. THEN HE WANTED TO SEE THE SPEED

MEASURING DEVICE SPEED- DECLINED.

*Apparently asking basic questions makes you a "smart mouth".

In terms of note taking, these are average/above average.

As for as calibration goes, from what I remember, it's a one and done thing when they're new or if they've been repaired.

If you're talking about testing, they are usually tested before and after a shift by an officer, which is noted in your disclosure. In the old days, they'd do this with tuning forks. These days, I believe all that's required is a push of a button. The manufacturers have removed tuning forks from the Ontario specific manuals for many years now.

The officer was correct in that he can decline your roadside requests for evidence as the side of the road is not a courtroom. That being said, all those extra notes are neither here nor there.

Any suggestions on a defence?

Speeding is what they call an "absolute liability offence."

Anything other than "I was not speeding" wont be taken into consideration.

Any actual suggestions? This is not helpful

The officer was wearing a body cam and recording for my speeding ticket. I requested in my disclosure that they provide this footage. The disclosure did not contain it. Any suggestions on if and how I can get my case thrown out?
