Hi everyone,


Sorry for reviving this old thread, but it seems the most relevant to my situation. I am fighting a Careless Driving ticket and have requested disclosure as soon as I got my court date. I used the form on the Ticketcombat website (amazing site with great tips btw!) and faxed it to the Newmarket courthouse at 905-898-5218 with confirmation. Could anyone please confirm that fax number for me?


In any case, it's been exactly 3 weeks now and no response. As suggested, I left out my phone number and just included my address on the request. As I have read, many courthouses don't mail out disclourse material. So in this case, how will I know when disclosure is ready for me to be picked up? Do they write me a letter by mail? What if they deny or say that I didn't provide enough information? Do they also ask that by mail as well? Finally, should I make a second request for disclosure by faxing the exact same request as my first one?


My court date is September 30, 2010. Thank you for your help.

Your court date is still a ways out, in legal time, so don't sweat too much. If you wish you can always fax another request off, maybe in another week. If you can show the paper trail your good. As long as you have been prudent and reasonable and can show it the JP can do anything from offering a continuance if your disclosure is not ready, or handed to you late, to staying the charge.....

Thanks for the reply Reflections. I haven't had much time anyways to send out another request. I'll get to that some time this week. Should the second request be the same as the first one? I'm planning to say that it's my second request and that if there are any issues with the request, they should contact me by mail at my address.


I'm hoping that if they don't provide disclosure, they will stay the charge. If I requested to stay the charge for this reason and it gets denied by the JP, does that mean the trial continues and I can still try to prove my innocence?
