When police lay a highway traffic act charge, they can proceed with a regular offence notice (a ticket) or summons. A summons requires you to attend Court, and is typically used for more serious charges, especially those with no set fine. If you had been given a summons, the errors that would result in a normal ticket being thrown out, don't apply.

It doesn't sound like you were given a summons however, since there is a fine listed on your ticket. Summons do not list any fine, since it's to be set by the Court upon conviction.

Just a follow up.....Our paralegal went to my first attendance meeting yesterday and everything was dropped , no charges, no fine and no points. Now I am wondering if we will get our deductable back from our insurance company?

deductible has nothing to do with the outcome of the HTA charge, so it is very unlikely
