Family member was sitting at a red light, in the left turning lane.
Light changed to Green with advnaced green arrow.
We proceeded into the intersection and so did the car across the intersection. (facing us)
Yes, the other car is seeing a red light.
A collision occured. City police showed up and charged us with "Turn - not in safety".

The other driver was not charged.
Am I missing something here?

Were you facing an advanced green arrow along with a circular green for traffic in the same direction? If so, as long as you can prove that you had the advanced green, the HTA does not require you to yield to through traffic - pretty much the only time that left-turning traffic ever has right-of-way over everyone else.

144 (13) A driver approaching a traffic control signal showing a circular flashing green indication or a solid or flashing left turn green arrow indication in conjunction with a circular green indication and facing the indication may, despite subsection 141 (5), proceed forward or turn left or right unless otherwise directed.
