wrong HTA section - careless driving cited?

I got stopped for speeding on a Highway and the ticket reads "130 km/hr in a posted 100 km/hr" but the HTA section written on the ticket is Section 130 (careless driving) instead of Section 128. The fine written is the amount applicable to 130 km/hr speeding. After reading about errors on the ticket, this error appears to be a fatal error (ie. narrative does not support the charge).

Is this a fatal error?
