HTA

106. (1) No person shall drive on a highway a motor vehicle in which a seat belt assembly required under the Motor Vehicle Safety Act (Canada) at the time that the vehicle was manufactured or imported into Canada has been removed, rendered partly or wholly inoperative, modified so as to reduce its effectiveness or is not operating properly through lack of maintenance

How to wear seat belt assembly

106 (5) A seat belt assembly shall be worn so that,

(a) the pelvic restraint is worn firmly against the body and across the hips;

(b) the torso restraint, if there is one, is worn closely against the body and over the shoulder and across the chest

Based on those 2 sections, would say illegal to use a 3 point seatbelt b/c

1) that the original seatbelt as manufactured has been removed

2) that the 3 point harness does not go across the chest (ie: left shoulder to right hip and/or right shoulder to left hip)

Then would want to ask for a lot of documentation of the following to see if it meets Canadian Standards on

1) Seat Belt Assemblies

http://www.tc.gc.ca/eng/acts-regulation ... iv-209.htm

2) Seat Belt Anchorages

http://www.tc.gc.ca/eng/acts-regulation ... iv-210.htm

3) Achorage of Seats

http://www.tc.gc.ca/eng/acts-regulation ... iv-207.htm

4) Do seats meet requirements (I couldnt find it, but sure its somewhere)

Then will insurance even cover your vehicle/occupants if modified from manufacturer intended design, without a certification from Transport Canada?

I don't know, just throwing it out there

Above is merely a suggestion/thought and in no way constitutes legal advice or views of my employer. www.OHTA.ca

Are the seats that much different that you need a different style of belt?
